Client suffered severe injuries due to a pattern of abuse and neglect at a local nursing home. Gary Schaaf served as co-counsel at trial with Carl Wilander and Ross Mann. This verdict has been reported by Kentucky Trial Court Review as the largest injury verdict in McCracken County history. Defendants have appealed the verdict and filed bankruptcy, which has stayed the proceedings.
Client suffered brain injuries when a semi crossed the center line and ran over the client’s car.
Client suffered fatal injuries due to medication errors.

Nursing home resident fell from chair striking her head, suffering a significant brain bleed which led to her death.
Nursing home resident suffered bed sores, pneumonia, and urinary tract infections leading to his death.
CAR V. SEMI WRECK (PLAINTIFF ON THE JOB) CONFIDENTIAL
Nursing home resident suffered multiple falls resulting in fractures, pressure ulcers, urinary tract infections, upper respiratory infections, contractures and malnutrition, which ultimately led to her death.
Shoulder injury. Our client was driving his vehicle when a semi tractor-trailer pulled out in front of him resulting in a collision.
Foot, neck, and back injury. Our client was driving her vehicle when another vehicle turned in front of her resulting in a collision.
Nursing home resident suffered severe dehydration, bed sores and a urinary tract infection which spread to his kidneys resulting in sepsis and death.
Disc herniation requiring surgical intervention. Our client was injured while working on a barge when equipment failed.
Clients suffered arm and leg injuries requiring multiple surgeries after being struck by an impaired driver.
Nursing home resident developed painful bed sores that worsened, became infected, ultimately leading to his death.
Elderly client suffered a misdiagnosed brain bleed.
Our client underwent a right shoulder replacement. Medical providers failed to perform post- surgical neurovascular checks, leaving our client with compartment syndrome and little use of her upper extremity.
Fractured hip, dehydration, UTIs and bed sores.
Multiple blunt trauma resulting in death.
Nursing home resident suffered a urinary tract infection which ultimately led to her death.

Left wrist injury requiring open reduction, internal fixation.
Neck and back injuries requiring multiple surgeries. Client was a passenger in a vehicle and was injured in a collision caused by the defendant not properly securing a ladder in his/their company vehicle for transport while traveling on the highway.
Client was a pedestrian and on the job when struck while changing a tire for a broken down motorist. Client sustained a large hematoma with seroma (requiring surgery) a closed superior fracture of the pelvis and complex regional pain syndrome type 1 of the lower extremity.
Client suffered multiple falls while a resident of nursing home, resulting in a compression fracture requiring surgical intervention.
Nursing home resident suffered hematomas, decubitus ulcers and multiple contusions following a fall at the nursing home.
Clostridium difficile (C-Diff). Our client was released from the nursing home with C-Diff. She had to undergo emergency surgery to remove a large portion of her intestines.
Foot fractures requiring surgical repair.
Client suffered compound fractures of her arm requiring surgery after another driver ran a red light.
Fractured pelvis and crushed foot. Our client was a passenger in a vehicle when another vehicle crossed the center line resulting in a head on collision.
Nursing home resident suffered falls, infections, cellulitis, skin abrasions, ulcers and wound necrosis.
Client was the driver of a semi-truck when a vehicle crossed the center line. Client suffered an ankle fracture and underwent an open reduction with internal fixation.
Fractures to the ribs, pelvis, hip, foot, and ankle. Our client was driving his vehicle when another vehicle failed to yield resulting in a collision in which our client suffered multiple fractures.
Client fell 30 feet from a bucket truck. Client suffered multiple injuries, including a humerus fracture, ulna shaft fracture, L1-L3 transverse process fractures, L2-3 disc extrusions, rib fractures, a pulmonary contusion, pneumothorax, liver contusion, bilateral adrenal hematomas, liver laceration, nasal fracture, and calcaneus fracture.
Ruptured disc and hip pain. Our client was an employee unloading cases when he slipped and fell off of a step/platform landing on his right side injuring his back and hip.
Multiple injuries. Client was a passenger of a vehicle that was involved in a crash on the highway with a semi.
Client was a front seated passenger in a head-on collision. The client suffered injuries to the chest, wrist, a left transverse process fracture, an L1-L2 transverse process fracture, an L5-vertebral body fracture, and ankle fracture.
Client was a passenger in a vehicle that ran off the road. Client suffered multiple fractures of arm and fractured pelvis.
Injury was a complete comminuted displaced transverse fracture through the proximal shaft of the right femur.
Multiple injuries. Client was a driver of a vehicle that was involved in a crash on the highway with a semi.
Brain injury, resulting in death. Our client was operating her vehicle when a Semi pulled out in front of her.
A vehicle turned in front of our client’s vehicle. The client underwent a cervical discectomy and fusion at C6-7.
Nursing home resident fell multiple times and suffered a left hip fracture. She passed away before being discharged from the hospital.
A vehicle side-swiped our client’s vehicle, running him off the roadway and into a fence. The client underwent an anterior cervical discectomy with fusion at C3-C5.
Client was a driver of a vehicle involved in a severe rear-ended collision. The client sustained a right distal radial fracture (requiring surgery), a right hip hematoma (requiring surgery), and a sacral fracture.
Client was involved in a boating accident on Kentucky Lake and sustained a traumatic compression fracture (requiring surgery).
Knee fracture and torn retina.
Client was in a collision with a semi. Client suffered a neck injury requiring neck surgery.
Subdural hematoma and right orbital fracture. Our client got her foot caught in a door mat causing her to fall forward.
Client was the driver of a vehicle that was struck by another vehicle that failed to yield the right away. The client sustained a neck injury and multiple abrasions and contusions.
Leg fracture and knee dislocation. Our client was an employee performing work duties when a car rolled off a lift and pinned his knee between two vehicles.
Neck pain and back pain. Our client was a passenger in a vehicle. A semi tractor-trailer side swiped the vehicle causing it to hit the railing.
Nursing home resident suffered traumatic C4-5 subluxation with spinal cord injury. He was later found unresponsive and passed away due to his injuries.
Client was rear-ended and sustained a shoulder injury requiring surgery.
Client was a pedestrian who was run over while checking her mail box. Client sustained a closed displaced comminuted fracture of the left femur and a displaced fracture of the shaft of the left 3rd metacarpal (requiring two surgeries).
Neck injury. Client underwent an anterior cervical discectomy and fusion of C5-6 and C6-7 due to injuries sustained in a car accident.
Ankle fracture, toe fracture, rib fractures and pneumothorax. Our client was a driving her vehicle when another vehicle turned in front of her resulting in a collision.
Blunt force trauma resulting in death after pick-up truck failed to yield the right of way to motorcyclist.
Groin strain/hernia. Our client was an employee performing work duties when he lifted a heavy door and injured his groin resulting in hernia repair surgery.
(PLAINTIFF ON THE JOB)
Injuries to knee, leg and shoulder. Client was backed over by a vehicle while on the job.
WORKERS’ COMPENSATION
Our client was driving her vehicle when another vehicle turned in front of her resulting in a head on collision. Our client suffered an ankle fracture/dislocation.
Broken hip/femur. Our client was a walking through a vestibule area when she slipped on wet tile flooring and fell.
Back injury and arm/shoulder injury. Our client was driving his vehicle when another vehicle pulled into his path resulting in a collision.
Anterior cervical discectomy and fusion. A vehicle changed lanes striking our client’s vehicle.
Client was a driver of a vehicle involved in a rear-end collision sustaining a traumatic brain bleed, broken ribs, a broken ulna and a leg laceration (requiring surgery).
Client suffered a subarachnoid hemorrhage (brain bleed) when she was a passenger in a vehicle that was rear-ended.
A vehicle crossed into our client’s lane of travel. The client underwent a cervical discectomy and fusion at C5-6.
Client was a passenger in a car that ran off the road and struck a tree. The client sustained a fractured thumb, a broken sternum, four (4) broken ribs, and a fracture of the L4 vertebrae (requiring surgery).
Neck and back pain, ankle fracture, leg laceration requiring sutures, rib fractures, pulmonary contusion, pneumothorax, facial abrasions and cracked teeth. Drunk driver crossed centerline and struck our client’s vehicle head-on.
Injuries were a displaced, transverse comminuted fracture of the right distal radius and a displaced fracture of the ulnar styloid process.
Rib fractures, pulmonary contusion, and pneumothorax. Our client was driving his vehicle when another vehicle turned in front of him resulting in a collision.
Fractures to ribs, clavicle, hand, knee and spine.
Injuries to hip and foot requiring surgery. Client was hit by a drunk driver in a severe collision.
Fractured sternum and shoulder injury. Our client was driving her vehicle when another vehicle crossed the center line resulting in a collision.
Client was a passenger in a vehicle that was struck when another vehicle ran a red light. The client sustained a compression fracture of the lumbar L2 vertebra.
Client was a passenger in a head-on collision. Client suffered injuries to the chest, breast, abdomen, multiple rib fractures, back, ankle and feet.
Cervical strain and rotator cuff surgery. Our client was rear-ended.
Back injury. Our client was an employee performing work duties when he lifted a box and injured his back.
Shoulder and leg injury. Our client was driving his vehicle when he was struck by another vehicle from behind.
Humeral shaft fracture with 100% displacement requiring surgical repair.
Shoulder dislocation, tibiafibula fracture, knee injury, facial fractures, foot fractures, hand laceration with exposed tendon.
Client was riding a motorcycle when a vehicle pulled out in front of him. The client sustained injuries to his ankle and neck.
Client was a pedestrian who was struck by a vehicle. The client sustained head and neck injuries.
Client sustained an injury to her right arm and shoulder from a fall that was caused by a poorly maintained floor.
Client was the driver of a vehicle in a head-on collision and sustained a closed fracture of the distal radius (broken wrist), tear of the rotator cuff with impingement, and a labrum tear.
Client was a driver of a vehicle involved in a rear-ended collision and sustained three (3) fractured vertebras, a dislocated of the knee with ruptures of the ACL and lateral and medial meniscus (requiring surgery).
Client suffered a back injury from a T-bone collision.
Cervical and shoulder injuries. Our client was an employee delivering packages when he slipped on ice falling and hitting his neck and shoulder.
Foot fracture, shoulder injury requiring surgical repair, head lacerations and knee pain. Our client was riding a motorcycle when a vehicle pulled out in front of him.
Sacral and L5 fractures. Our client was a passenger on a motorcycle when a vehicle pulled out in front of them.
Neck injury. Our client was an employee performing work duties. He was opening a valve when the wrench he was using slipped, causing him to fall backwards and injure his neck.
Our client was found in her bed unresponsive. The oxygen hose she was hooked up to was shredded.
Disc herniation. Our client was an employee lifting windows and placing them on a cart when he injured his back.
Client was a driver in a head-on collision. The client suffered injuries to the head, chest, lung, knee, and back.
Injury was a displaced comminuted right transverse patellar fracture and a tear of the medial and lateral retinaculum requiring an open reduction with internal fixation of the knee.
Nursing home resident suffered a significant decubitus ulcer on her buttocks and low back area which was extremely painful and became infected.
Pneumothorax, back injury, and neck injury. Our client was driving her vehicle when another vehicle failed to yield resulting in a collision.
Neck strain, back pain, bilateral shoulder manipulation in both shoulders. Our client was struck head-on.
Transverse process fracture, abdominal contusion and chest contusion. Our client was driving her vehicle when another vehicle ran a red light resulting in a collision.
Client was involved in a sideswipe collision sustaining a comminuted fracture of the C2 vertebra with extension into the C1 facet joints bilaterally (broken neck).
Client was the driver of a vehicle struck head-on. The client suffered a fracture of the distal clavicle and a herniation at C4-C5 with radiculopathy.
Client was the passenger in vehicle that struck an embankment. The client sustained injuries to the chest, cuts and bruised arm/elbow, and a collapsed lung/pneumothorax.
Pelvic injury. Our client was a pedestrian who was hit by a vehicle while walking down the road.
Our client was driving her vehicle when another vehicle crossed the center line resulting in a head on collision in which our client suffered fatal injuries.
Client was struck by another vehicle. The client was diagnosed with an L2 vertebral body superior endplate and compression fracture (a burst fracture of the lumbar vertebra).
(PLAINTIFF ON THE JOB)
Multiple life threatening injuries. Client was a driver of a work vehicle and hit by another driver in a severe collision. The Defendant driver failed to yield the right of way by crossing the street and pulling directly into the path of our client.
SPOUSAL CONSORTIUM
Nursing home resident suffered pressure ulcers, urinary tract infections, respiratory infection, C-diff infection, malnutrition, severe weight loss, and ultimately death.
Neck, back, right sided rib pain and chest contusions. Our client was waiting to pullout of a drive and was backed into by a truck that was backing along the shoulder of the roadway.
Neck pain, bulging discs in back, shoulder pain and hip pain. A vehicle failed to stop at a red light and turned in front of our client’s vehicle.
Hand injury and headaches. Our client was driving a work vehicle. Another vehicle crossed the center line, side-swiping our client, forcing him into the guardrail.
Fractured sternum, knee injury, L4 compression fracture, and chest bruising. Our client was a passenger in a vehicle when another vehicle crossed the center line.
Client suffered a right ankle fracture and right knee medial meniscus tear when a vehicle pulled out in front of her from an inferior roadway.
Client was hit by a vehicle while on a horse. Client sustained a comminuted fracture of the left calcaneus (requiring surgery)
Rib fractures, pneumothorax and shoulder AC separation. Our client was a passenger in a vehicle. The driver lost control of the vehicle causing it to leave the road and overturn.
Neck injury, arm pain and numbness. Our client was an employee performing work duties when he lifted a box, injuring his neck.
Injuries to neck, back, and ear. Client was a driver of a vehicle that was involved in a severe collision. The Defendant was exceeding speed limits and not under proper control causing a collision on an overpass.
Left clavicle fracture and permanent scarring. Our client was a back seat passenger in a vehicle that was struck by an uninsured motorist.
Client suffered arm injuries following a motor vehicle wreck.
Neck and back pain. A vehicle backed out of a driveway in front of our client.
Right shoulder complex tear requiring surgical repair and C5-6 disc protrusion. Our client was at a complete stop at a stop sign when she was rear-ended.
Injuries were fractures to tibia, fibula and both ankles requiring surgery. Client tripped over concrete uneven steps that were not up to code at a place of business.
Injuries were a concussion (with loss of consciousness), fracture of the second lumbar vertebra/L2 transverse process fracture, cervicalgia with a radicular component.
Injury to hand requiring surgery.
Client was rear-ended sustaining injuries to her neck, shoulder, and back.
Clavicle fracture.
Closed head injury, intracranial hemorrhage left tibial fracture and rib contusions.
Injuries to knee and back. Client struck by vehicle while flagging traffic.
Leg contusion, back pain, and neck pain. Our client was a passenger in a vehicle when another failed to yield.
Injuries to right arm (broken) and left knee cap (broken). Client fell due to a rug that was rolled up at the front entrance of a place of business.
Injuries to neck, shoulder, back and right knee. Client was the driver of her vehicle and the Defendant pulled directly out in front of her causing a severe collision.
A vehicle turned in front of our client’s vehicle. Client sustained injuries to her neck, back, shoulders, knees, and wrists.
Client sustained cervical and lumbar strains and multiple contusions when a vehicle made a left-hand turn in front of him.
Neck pain and pain in both shoulders. A vehicle turned in front of our client’s vehicle.
Neck Injury requiring cervical radiofrequency ablation (RFA).

Injuries to head, neck, back and shoulder. Client was on the job and driving a vehicle that was involved in a severe collision. Defendant rear ended Plaintiff at red light.
Client sustained low back and shoulder injuries when she was T-boned by a truck.

Ankle injury. Our client was an employee performing work duties when a box fell onto his leg injuring him.
Neck and back injury. A vehicle pulled out in front of our client.
Disc bulge in neck and back, knee pain and shoulder pain. A vehicle changed lanes in front of our client’s vehicle, causing the collision.
A vehicle pulled out in front of our client’s vehicle. The client sustained injuries to his neck and back.
Injury to hip & leg requiring surgery. Client was passenger of a vehicle involved in wreck when Defendant failed to yield the right of way.
Injuries sustained to neck, right arm and thumb. Client was a driver of a vehicle that was hit by a stolen car with no insurance coverage.
Severe headaches, neck and back injuries. A vehicle crossed the centerline striking our client’s vehicle.
Dislocated hip and facial laceration.
Injury to shoulder (tear of the labrum which had to be surgically repaired). Client was rear ended by defendant while stopped at traffic light.
Injuries (multiple contusions and abrasions) to head, neck, chest, shoulder, back, leg and a sprained ankle. Client was the driver of a vehicle that was hit in the driver’s side door by the Defendant causing Plaintiff’s vehicle to overturn.
Cervical muscle spasms, lumbar strain and right should pain. Our client was rear-ended.
Neck pain, back pain. Our client was stopped at traffic light when another vehicle rear-ended him resulting in a collision.
